This Washington Consumer Health Data Privacy Policy ("WA Health Policy") is a supplement to the general Cover Technologies, LLC Privacy Policy. It applies exclusively to "Washington Consumers," defined as residents of Washington State or individuals whose health data is collected within the state.

At Cover Technologies, LLC (referred to as "we," "us," or "our"), we are committed to transparency regarding the sensitive information we handle while helping you navigate insurance products and services.

1. Understanding "Consumer Health Data"

For the purposes of this policy and MHMDA compliance, Consumer Health Data refers to personal information that is linked or reasonably linkable to a Washington Consumer and identifies their past, present, or future physical or mental health status.

What this includes:

  • Direct Information: Data you provide through our online forms, questionnaires, or verbal consultations.
  • Third-Party Data: Information received from our business partners or service providers to help facilitate your insurance quotes and applications.

What this excludes:

This policy does not cover:

  • Publicly Available Information: Data from government records or information you have intentionally made public.
  • Deidentified Data: Information that has been stripped of identifiers and cannot be re-linked to you.
  • Regulatory Carve-outs: Information already governed by HIPAA (Health Insurance Portability and Accountability Act), FCRA (Fair Credit Reporting Act), or GLBA (Gramm-Leach-Bliley Act). We provide separate notices for products governed by these specific federal laws.

To provide accurate insurance matches, we may collect:

  • Health Conditions & Diagnoses: Including medical history, symptoms, treatments, referrals, and physician consultations.
  • Health Service Identifiers: Information related to your search for care, such as height, weight, tobacco usage, and records of your interactions with us or our partners.

B. Purpose and Sources

We collect this data directly from you or the agents you interact with. We use this information for:

  • Requested Services: Processing applications, providing insurance quotes, and recommending specific coverage.
  • Legal Compliance: Preventing fraudulent activity and ensuring we meet all regulatory obligations.

C. Sharing Your Data

To provide the services you request, we may share your health data with our affiliates and insurance carrier partners (and their authorized agents) so they can generate accurate quotes for you.

3. Your Privacy Rights and Choices

Under the MHMDA, you possess specific rights regarding your health data, subject to certain legal exceptions:

  • Right to Confirm & Access: You may ask us to confirm whether we are collecting your health data and request a disclosure of that specific data.
  • Right to Deletion: You have the right to request that we (and our contracted processors) delete the health data we maintain about you.

We may decline a deletion request if the data is necessary to:

  1. Detect and prevent security incidents, identity theft, or illegal activities.
  2. Maintain the integrity and security of our technical systems.
  3. Comply with ongoing legal investigations or prosecutions.

Verification Requirements

To protect your privacy, we must authenticate your identity. We will ask for your full name, address, phone number, and email. If we cannot verify you using our existing records, we may request additional documentation.

  • Authorized Agents: You may use an agent to submit a request, but we will require proof of their authority to act on your behalf.
  • Minors: Parents or legal guardians may submit requests for their minor children.

Response Timeline

  • Standard Timing: We aim to respond within 45 days.
  • Extensions: If we require more time (up to an additional 45 days), we will notify you in writing of the reason for the delay.
  • Fees: Generally, these requests are processed free of charge. However, we reserve the right to charge a reasonable fee for requests that are repetitive or excessive.
